Lawsuit Alleges Student Sex Assault at Elementary School
Parent Blames Staff and School District for Negligence

The parent of a Discovery Oaks Elementary student is suing the school district for an alleged sexual assault. The family is asking the court for damages and fees of more than $100,000.
According to court documents, the assault happened on May 16, 2023, when the victim and another student were allowed to go to the restroom during a physical education class. The alleged attacker had a “propensity for inappropriate behavior,” lawyers for the parent wrote.
The interaction between the two students is described as “inappropriate touching” that led to permanent and continuing “bodily injury and resulting pain and suffering, impairment, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, expense of hospitalization, and medical and nursing care and treatment.”
Neither the victim nor her alleged attacker is named in the lawsuit, as both are minors.
The lawsuit was filed in March. The Clay County School District denied all of the allegations. A mediation session was held on August 14. Details of the mediation are scarce, but it was apparent the parties did not reach a resolution.
Since the mediation, lawyers for the parent have requested a slew of additional info from the school district, including:
Documentation of measures taken to prevent the perpetrator from harming other students
Details on any other instances of assault committed by the perpetrator
Names and pertinent details of all school employees charged with watching the students during the P.E. class on the day of the incident
Court records show the plaintiff served the school district with a settlement proposal on August 28, though no settlement details are provided. Clay News & Views will provide updates as the story progresses.
