Absolutely terrifying how the manufacturer is deflecting blame onto operators when the patern is so clear across multiple cases. The water ballast system makng sense for stability at rest but then becoming a liability during deceleration is textbook engineering oversight. I've seen this kind of corporate response in other product liability cases, basically hoping to muddy the waters until people forget. That Maine report laying out the physics so clearly should be a wakeup call.
